Recent Representative Matters

Client was law firm which represented two defendants in underlying fraud action brought by a sister of one of the defendants. Clients became delinquent in payment of law firm fees due under a written fee agreement. Clients signed a promissory note and deed of trust as security for past unpaid and future fees. A conflict of interest arose between clients, who obtained separate counsel. Law firm initiated foreclosure pursuant to deed of trust to collect unpaid fees. Clients initiated an action to restrain the foreclosure, claiming negligence, legal malpractice and breach of duty. Law firm cross-complained for unpaid fees. The case resolved completely in favor of law firm. Clients agreed to pay all unpaid fees and costs, plus accrued interest, and dismissed their complaint with prejudice.

Represented Federal Insurance Company in a years-long bad faith and coverage dispute brought by former officers and directors of a major software company under a Directors and Officers policy, which case resolved by settlement.

Represented U.S. distributor of plumbing supplies in two construction defect cases involving large condominium projects in downtown San Diego, for claimed supplied defective Chinese storm, waste and vent cast iron pipe.  The first case resolved with a dismissal with prejudice, the second resolved with a minimal settlement payment.

Representation continues in several comparable actions.

Represented FrontRange Solutions, a computer software distributor, in an unfair business practices case. The plaintiff claimed he had repeatedly received unsolicited advertisements via fax that were sent by FrontRange or one of its agents, in violation of federal and state law. Mr. Amundson filed a motion for, and was granted, summary judgment in favor of his client on the basis that the plaintiff had no factual support for his allegations.

Initially represented the San Diego-Imperial Council, Boy Scouts of America in a real property boundary dispute.  The Council had ongoing issues over the boundaries of its Mataguay Boy Scout camp property with owners of adjacent plots.  Mr. Amundson achieved a favorable court judgment in the first action that resolved all boundary conflicts in favor of the client.  A second action had to be commenced to remove people who remained as unlawful residents.  A favorable judgment for possession was obtained and upheld on appeal.

Represented the owner of a vehicle that had been involved in a fatal collision in a wrongful death case. The vehicle was being driven by a friend of the owner's step-daughter at the time of the crash without the owner's knowledge. Mr. Amundson filed a motion for summary judgment on behalf of the vehicle owner, on the grounds that there was not sufficient evidence that his client had given the driver permission to use the vehicle, or to establish negligent entrustment. The court granted the motion. When the case involving the step-daughter and the driver as remaining defendants later went to trial, the jury delivered a multi-million dollar verdict in the plaintiff's favor.
